These Terms of Service ('ToS', or 'Terms') of DOMAINHACKS.INFO ('Company', 'we', 'us', or 'our'), describe the conditions between you and us when using our website, tools, and/or services ('Services').

Prohibited activities further include high-volume use of our Services and non-purposeful use of our Services, e.g. by checking availability or searching for keywords just to overload our services. You also agree to respectfully use the availability checks of domains as we are using third party whois services which may be limited in terms of access within certain time frames. Further, prohibited activities include searching for keywords that have the potential to: harass, abuse, insult, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability as well as every other protected characteristic protected by law. In case you perform any of the prohibited activities, we may immediately terminate your access to our Services, if applicable, without any refund.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. Refunds

In Short: Marketplace listings are non-refundable once the listing is live on our site. Unapproved listings will not be refunded. If a listing is losing its purpose (e.g. because the promoted domain hack has been sold), we reserve the right, but are not obligated, to take the listing offline, without further notice. Membership Upgrades (i.e. 'Company' and/or 'Domainer') are non-refundable after 24-hours from the time of purchase, or if you have already used any of the benefits associated with the membership upgrade. Marketplace Credits are non-refundable. All refunds are subject to a 10% processing fee, additionally to all paid fees by us in connection with your refund.

In Short: Certain parts of our Services may include materials from third-parties. Some links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Warrenties

In Short: The statutory warranty provisions as contemplated under § 600 BGB shall apply to the no-charge functions of the Platform or in the event of their no-charge transfer. With respect to the fee-based Services, in the event of any defects §§ 536 et seqq. BGB as well as provisions (a) through (d) below shall apply: (a) The no-fault liability for incipient defects as contemplated by § 563a para. 1, 1 variation BGB, shall be precluded. The no-fault liability of us shall continue in existence. In the event determination is made that we are culpable, it shall be acknowledged by you that the Services as factual matter cannot be created in a fully error-free manner. (b) The remediation of any defects shall be effected, at our sole descretion, either by subsequent improvement at no charge or by a replacement delivery. (c) Your termination in accordance with § 543 para. 2 sent. 1 no. 1 BGB due to non-granting of the use as contemplated by the contract shall be permissible only if we were given sufficient opportunity to eliminate the defect and such has failed. (d) We shall assume no warranty for your internet access, including, but not limited to, the availability and dimensioning of the internet access.
